1. Purpose
These terms govern the use of the Nemae app, published by HUYNH Ba Thinh (D-Sign Dev).
By creating an account, you accept them.
2. What the app does — and what it does not do
Nemae is a personal tracking notebook. It lets you record and find the health information of a person you care for, and share it with other loved ones if you wish.
It is not a medical device. It provides no diagnosis, no treatment recommendation and no clinical alert. It replaces neither a healthcare professional nor a medical record.
No healthcare professional has access to the app: it is a notebook kept by a family, for itself.
The medicine suggestions offered during entry come from the ANSM's public database. They are not a prescription: it is up to you to check that what you record matches the prescription.
3. The account
Access is by a code received by email. You are responsible for access to your mailbox.
An account is personal. To give someone else access, use the invitation feature provided for that purpose.
4. What you undertake to do
- to record only information about a person you actually care for, with their consent or as their legal representative;
- to invite into a space only people who are entitled to access it;
- not to use the app for unlawful purposes.
You remain responsible for the information you enter and for the people you give access to.
5. The subscription
Nemae offers three plans. Current prices are shown in the app, in your country's currency.
Nemae Free
- one person cared for;
- a limited number of documents in the Vault;
- a limited number of prescription-reading attempts;
- use on your own, without inviting other carers.
Nemae Plus
- a limited number of people cared for;
- sharing a space with other carers, within the number shown in the app;
- a Vault with no limit;
- prescription reading with no limit.
Nemae Family
- everything included in Nemae Plus;
- no limit on the number of carers per space.
A subscription covers all the spaces opened by the person who pays. The other members of a space benefit from it without having to pay.
Exporting your data, reminders and the Profile sheet remain free on every plan.
Subscription, renewal and cancellation
The subscription is taken out and billed through the App Store or Google Play. It renews automatically at the end of each period, unless cancelled at least 24 hours before the renewal date.
Cancellation is done in your Apple or Google account settings, never in the app. Refund conditions are those of the platform concerned.
You can change plan at any time. Moving to a higher plan takes effect immediately; moving to a lower plan takes effect at the end of the current period.
On expiry
No data is deleted: only the paid features stop being available. People already in a space remain there; only new invitations are refused while the plan's limit is exceeded.
6. Availability
The app is provided as is. The publisher endeavours to keep it available but cannot guarantee uninterrupted availability, in particular in the event of maintenance or the failure of a service provider.
Some features require a connection. Information already viewed remains accessible offline, in its last known state.
7. Liability
The publisher cannot be held liable for:
- incorrect information entered by a user;
- a reminder not received because of the phone's settings, the phone being switched off or notifications being refused;
- a health decision taken on the basis of the information recorded;
- the use made of the information by a person you have invited.
In an emergency, call 15 (SAMU), 112 (European emergency number) or 114 (for deaf and hard-of-hearing people). Never use this app as a way of raising an alert.
8. End of use
You can delete your account at any time from Settings. Deletion is immediate and permanent.
The publisher may suspend an account in the event of use clearly contrary to these terms, after informing the user where possible.
9. Changes
These terms may change. Any substantial change will be notified in the app before it takes effect.
10. Governing law
These terms are governed by French law.
In the event of a dispute, an amicable solution will be sought first. Failing that, you may refer the matter to a consumer mediator free of charge. The French courts have jurisdiction.
